    Company Regulations

    Introduction

    • The StoreChart website ("the Website") is operated by Comfortly Ergonomics Ltd. ("the Company"), registered number 516790979, and serves as a SaaS system for multi-channel sales management for online business owners.
    • These regulations apply equally to all genders, and any use of a specific gender is for convenience only.
    • Purchasing a subscription and/or using the Platform is subject to the terms outlined in these regulations.
    • By purchasing a subscription or using the Platform, the user declares that they have read, understood, and agreed to these regulations. These regulations constitute a binding contract between you and the Company.

    1. Definitions

    The following terms shall have the meanings specified alongside them, unless the context requires otherwise:

    • "The Platform": A SaaS system for multi-channel sales management, accessible via the website and/or application.
    • "The User": Any individual or legal entity using the Platform, including visitors, registered users, and paid subscribers.
    • "Subscription": A paid registration for using the Platform, on a monthly or annual plan.
    • "Content": Any information, data, text, images, or other materials uploaded or entered by the User to the Platform.
    • "Services": All services offered on the Platform, including order management, inventory, customers, reports, integrations, and CMS.

    2. Subscription & Purchase

    The Platform allows users to purchase a subscription conveniently, easily, and securely online:

    • A subscription can be purchased at any time through the pricing page on the website.
    • Purchases are made via credit card or other online payment methods, and the transaction will be processed upon approval by the payment provider.
    • Subscription prices are displayed on the website and include VAT as required by law.
    • The Company reserves the right to change subscription plans, features included in each plan, and prices, with 30 days' advance notice.
    • The subscription is personal and non-transferable to a third party without prior written approval from the Company.
    • The Company may refuse to provide service or cancel a subscription at its sole discretion.

    3. Pricing & Payment

    The service is offered on a periodic subscription model:

    • Billing occurs at the beginning of each subscription period (monthly or annually) according to the selected plan.
    • The subscription auto-renews at the end of each period unless canceled by the User before the renewal date.
    • Prices include VAT as required by applicable law. The Company may update prices with 30 days' advance notice.
    • In case of a billing failure, the Company may suspend access to the service until payment is resolved.
    • The Company offers a free trial period for new users. At the end of the trial period, payment is required to continue using the service.

    4. Cancellations & Refunds

    The cancellation and refund policy is governed by applicable consumer protection laws:

    • The subscription can be canceled at any time through the account settings in the Platform or by contacting customer service via email.
    • Cancellation takes effect at the end of the current subscription period. No prorated refunds will be given for the remaining period, unless otherwise required by law.
    • Under consumer protection law, a transaction may be canceled within 14 days of the transaction date with a full refund, minus cancellation fees of 5% of the transaction amount or 100 ILS, whichever is lower.
    • Cancellation requests will be processed within 14 business days of receipt. Cancellation confirmation will be sent via email.
    • Upon cancellation, the User's access to their data on the Platform will be maintained for 30 days from the cancellation date for data export purposes.

    Important: Under consumer protection law, the right to cancel within 14 days applies to ongoing transactions (such as subscriptions). If you have used the service, cancellation fees may include payment for actual usage.

    5. Service Availability

    The Company is committed to providing high-quality service and ensuring maximum availability:

    • The Company makes reasonable efforts to provide continuous and stable service 24 hours a day, 7 days a week.
    • The Company may perform scheduled maintenance and will endeavor to provide advance notice. Scheduled maintenance is typically performed during low-activity hours.
    • The Company shall not be liable for any delay, disruption, or interruption of service caused by force majeure, internet network failures, or events beyond its control.
    • In case of a significant service failure, the Company will act to resolve it promptly and update users through appropriate channels.

    6. Customer Support

    The Company provides professional customer support to subscribers:

    • Customer support can be reached via email, the contact form on the website, or other communication channels listed on the site.
    • Inquiries will be answered within a reasonable time frame based on the nature and priority of the inquiry.
    • Subscribers on business and advanced plans may have access to priority support according to their subscription terms.

    7. Warranty & Service Level Agreement (SLA)

    The service is provided "As Is" subject to the following terms:

    • The Company commits to maintaining a service level availability (SLA) of 99.5% monthly average, excluding scheduled maintenance.
    • The warranty covers material malfunctions in the Platform's operation caused by the Company.
    • The sole remedy for a malfunction covered under warranty is limited to fixing the issue or providing a proportional credit to the User's account.
    • The warranty does not cover issues caused by the User's misuse, unsupported third-party integrations, or factors beyond the Company's control.
    • The Company's total liability for any malfunction shall in no case exceed the payment made by the User for the month of service in which the malfunction occurred.

    8. Data Security & Privacy

    The Company is committed to maintaining data security and user privacy:

    • All data is encrypted in transit and at rest using advanced encryption protocols (SSL/TLS, AES-256 encryption).
    • The Company employs industry-standard security measures, including continuous monitoring, automatic backups, and role-based access control.
    • The Company commits not to use information provided by users except for the purpose of providing the service and in accordance with all applicable laws.
    • Personal information will not be disclosed or used for marketing purposes without the explicit consent of the User.
    • In cases beyond the Company's control and/or arising from force majeure, the Company shall not be liable for any damage resulting from data loss or unauthorized use.

    9. Intellectual Property

    All intellectual property rights in the Platform, including source code, design, logo, software, documentation, and all other materials are the exclusive property of the Company:

    • No copying, duplicating, distributing, publishing, reverse engineering, or any other use of Platform materials is permitted without written approval from the Company.
    • Data uploaded by the User to the Platform remains their full property. The Company receives a limited, non-exclusive license to use such data solely for the purpose of providing the service.
    • The StoreChart brand name, logo, and all related trademarks are protected by intellectual property rights and may not be used without authorization.

    10. Limitation of Liability

    Subject to all applicable laws:

    • The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the Platform, to the extent permitted by law.
    • The User is responsible for any damage to their business, data, or third parties arising from use of the Platform, except in cases where the damage was caused by the Company's sole negligence.
    • The Company is not responsible for consequences arising from third-party integrations or changes made by the User.
    • The User agrees to indemnify the Company against any claim, demand, or damage arising from a breach of these regulations.

    11. Law & Jurisdiction

    The interpretation and enforcement of these regulations and/or any action or dispute arising from them shall be governed exclusively by the laws of the State of Israel. The competent courts in the districts of Tel Aviv-Jaffa, Haifa, Jerusalem, or Be'er Sheva shall have exclusive jurisdiction.
